Employment Law

Labor & Employment Law

Labor and Employment Law is a prominent issue in the construction industry, not the mention businesses in general.  Today’s employers face a tangled web of complex federal, state, and local laws regulating the workplace. Knowing how best to comply with these laws can be challenging, and the ramifications of failing to do so can be costly and time consuming.

Design-Build Law takes preventative measures by advising clients of the various regulations to keep in mind during their operation, as well as by drafting various employment agreements, such as employment contracts, independent contractor agreements, employee handbooks and workplace procedures, compensation and stock plans, severance agreements, and non-compete and non-solicitation agreements. (See Contract Law)

However, it can be very tricky to navigate the modern workplace. Should a labor violation occur due to discrimination, harassment, overtime violations, unpaid wages, wrongful termination, or any other form of employer conduct, we are capable of resolving the dispute quickly and efficiently.

Design-Build Law represents both employers and employees in all types of employment-related disputes, including:

  • Overtime and related wage and hour claims
  • Sexual harassment and other forms of harassment
  • Race, sex, age, national origin, and religious discrimination
  • Americans with Disabilities Act (ADA)
  • Family and Medical Leave Act (FMLA)
  • California Family Rights Act (CFRA)
  • Wrongful and retaliatory discharge
  • Whistleblower cases
  • Employment, severance, and separation agreements
  • Non-competition and non-solicitation agreements

Workers’ Compensation & Personal Injury

In 2013, the construction industry made up 20.3% of worker fatalities in private industry according to an OSHA report―that is, 1 in 5 worker deaths last year were in construction. The leading causes of worker deaths on construction sites were falls, workers being struck by objects, electrocution, and workers getting caught-in or between equipment or trenches.  Our team consists of OSHA Certified Safety Professionals who are dedicated to preventing workplace accidents by providing clients with Safety Manuals and Safety Meeting Literature. Design-Build Law is currently working to provide Continuing Education courses to companies throughout Southern California to ensure that fatalities and injuries do not occur.

In the event that a personal injury or catastrophic injury occurs within the scope of employment, we represent insurance carriers, third-party administrators, self-insured employers, in all aspects of Workers’ Compensation law.  Whether the work-related injury occurs due to a single accident, a long-term injury, a stress-related illness, a disease or illness due to various exposures, or an aggravation of a pre-existing injury or condition, DB Law can guide you through the administrative procedures to ensure compliance with California Workers’ Compensation Laws.  In addition, where there is third-party liability, we are passionate about pursuing subrogation action in order to seek the maximum reimbursement.
