Business Immigration

Labor Certifications (Employment-Based Visas)

Is your company looking to sponsor a foreign professional?  An EB-2 immigrant visa may be a great solution when hiring foreign engineers, or any other professional with an advanced degree or an exceptional ability in the sciences.  Other employment-based (EB) visas to consider include EB-1 (priority workers), EB-3 (professional and skilled workers), and EB-4 (special immigrants).

Another solution would be to file for an H-1B visa, which is offered to employees who generally have a bachelor’s degree or higher degree in a complex or unique field related to the position.  However, H-1B has a cap of 65,000 visas each fiscal year, with certain exemptions for those with master’s degree or higher, or those employed by an institution of higher education, a nonprofit research organization, or a government research organization.

Due to the fact that few American students pursue expertise in the fields of science, technology, engineering, and mathematics (STEM), petitioning for labor certifications has become quite popular amongst engineering firms, technology companies, and contractors.  Design-Build Law is dedicated to assisting businesses in sponsoring foreign employees by providing sound advice regarding the various legal requirements for both the employer and the employee, as well as filing all the necessary applications, forms, and documents to benefit the company and the foreign professional.

EB-5 Investor Visa & Development

Are you looking to invest in a U.S. business to put you on a path to permanent residence? Or are you interested in financing your next development with foreign capital? Design-Build Law is highly involved in EB-5 investment projects by working closely with immigrants investing in U.S. businesses, particularly the development of land to build Continuing Care Retirement Communities (CCRCs) and Retail Shopping Centers.  We work with a team of designers, builders, developers, brokers, bankers, and private equity firms, to evaluate the feasibility of a project and determine its potential success for investors and the community.  EB-5 encourages the flow of foreign capital into the U.S. economy and creates numerous jobs for U.S. workers.  Given that the baby boom generation is beginning to retire, there is a high demand for senior retirement communities, as well as nurses, housekeepers, and other careers associated with such communities.
