Serving as outside general counsel for a national design-build client, we orchestrated a rapid resolution involving over $2.5 million in outstanding payments across four out-of-state healthcare projects. Our client, facing significant payment delays on these projects governed by AIA Document A141–2014, Agreement Between Owner and Design-Builder, engaged us needing to secure payment for completed work. To navigate the complexities of multi-state mechanics lien laws, we leveraged our network to hire co-counsel in the relevant jurisdiction. This strategic engagement facilitated a swift and favorable resolution through mediation within 66 days, securing most of the amount owed across all four projects. In addition to securing payment, we negotiated terms that severed our client’s ties with the project owner, protecting it from future claims. This highlights our ability to effectively and efficiently support clients facing complex, multi-state disputes, delivering positive outcomes even when projects extend beyond our firm’s licensing footprint.
