21-Day Completion Deadline for $3M Medical Facility

We represented a private equity real estate firm specializing in healthcare, senior housing, and multifamily properties to negotiate a fast-track construction contract using AIA Document A105–2017, Short Form of Agreement Between Owner and Contractor. The project, a foundation and floor slab remediation at one of their medical facilities, required a complete shutdown of operations, creating significant time pressure. The contract mandated a demanding 21-day completion schedule with near around-the-clock work to reduce disruption. This compressed timeframe created unique legal challenges, including navigating the Illinois Mechanics Lien Act, which is typically structured around monthly payment schedules, not accelerated weekly payments. We also navigated complex logistical challenges, including coordinating the contractor’s work with separate, simultaneous work by a specialized healthcare contractor.
