Design-Build Contract Negotiated for Developer’s Mixed-Use Project

We represented the property owner to negotiate AIA Document A141–2014, Agreement Between Owner and Design-Builder, for a mixed-use project involving office, commercial, and restaurant space. The project incorporated a flexible program, emphasizing collaboration with the design-builder to finalize design, budget, and spatial needs. The agreement addressed site complexities, including reducing impacts on adjacent structures. Exhibits detailed the design scope, preliminary concepts, and the owner’s program. The design-builder was committed to meeting key project milestones, including targeted start and completion dates – critical milestones because the project is part of a larger redevelopment initiative. Our client sold property to the city for a future public parking garage, then leased it back for temporary parking during construction. Timely project completion was essential, as it triggered the lease termination and allows our client’s construction of the parking garage, ensuring the success of the overall redevelopment plan and associated public funding.
