We represented an architecture firm in a multifaceted dispute involving a building project with disagreements regarding the scope of services, including the architect’s responsibilities for specialized engineering considerations and the use of architectural drawings for various approvals and permit applications. Complicating matters were differing views on addressing unsuitable soil conditions and the proper procedures for obtaining necessary governmental approvals. We negotiated a comprehensive settlement that also addressed outstanding fees, clarified ownership and permitted use of the architect’s instruments of service, and established a clear path forward for the owner to engage a successor design professional, with a full release of all claims against our architect client.
