For example, we negotiated a master services agreement between a publicly traded mobile network operator and an architecture company for a wide range of design services. In that contract, we emphasized confidentiality protection, such as safeguarding sensitive data and articulating professional obligations in ongoing engagements.

We also served as counsel to a real estate developer in the negotiation of AIA Document B105–2017, Short Form of Agreement Between Owner and Architect, for a feasibility study examining the possibility of converting an existing commercial building into a fully functional data center. The study included a detailed scrutiny of structural, MEP, mechanical, electrical, and plumbing systems as well as conceptual planning of space and site access—important factors in mission-critical infrastructure development.

Resolving Challenging Construction Disputes

Our firm extends beyond development and design to include dispute resolution. In one matter, we advised a data center cabling subcontractor in a dispute over cost increases on a multi-million-dollar, multi-phase technology campus construction project. Labor shortages and increasing costs imposed severe pressures. We helped our client mitigate losses by analyzing the complex contractual relationships among the owner, general contractor, and required partner company, and developing a plan to navigate the conflict and protect their business interests.
