Healthcare projects often present particularly complex legal challenges. We have handled cases from mediation to litigation when necessary, such as leading foreclosure litigation of a $7.7 million mechanics lien where settlement efforts were unsuccessful. In another instance, we achieved a mediated recovery of $2.5 million in fees for a design-build client on four multi-state projects.
We’ve also stepped in during crises. On one project, we developed an Owner-Contractor Agreement permitting the expenditure of $3 million in just 21 days on slab repair at an in-service medical complex. That very aggressive schedule necessitated careful contract preparation in concert with the Illinois Mechanics Lien Act and coordination among multiple contractors.
Apart from execution, our services help clients mitigate long-term risk. In one instance, we negotiated a walk-away contract that absolved an architect of future responsibility while licensing design documents for use by a replacement architect.
Elsewhere, we have advised on lender-recommended lien subordination, negotiated design-build contracts on cost-plus and lump sum terms, and drafted contracts addressing limitations on the timing of construction, disruption of occupancy, and program-related requirements.
