In one matter, we represented an architecture firm engaged in a $150 million pharmaceutical manufacturing facility for an international pharmaceutical company, involving multi-story cleanroom production spaces, labs, process equipment platforms, and climate-controlled areas. Our client had worked on the project’s master planning for over a decade. When it came time to execute the full build-out, the company selected a design-build delivery model that required careful coordination among many participants.
The owner’s internal subject matter experts worked in parallel with a process engineering firm and a separate group of consultants hired under a different contractual chain by the design-builder. Meanwhile, our architecture firm client, serving as architect of record, retained a structural engineer under AIA Document C401–2017, Agreement Between Architect and Consultant. The structural engineer’s involvement was critical given the high-stakes nature of the project. We negotiated that C401 agreement alongside our client’s prime agreement with the design-builder – ensuring that design responsibilities, liabilities, and information flows aligned across all tiers of participants. The pace and complexity of the project required the architect to balance its professional liability obligations with the client’s demand for schedule certainty, as any delay could significantly affect revenue because of halted production of high-value pharmaceutical products.
In other matters, we negotiated multi-year master architectural services agreements for clients providing professional design services to global pharmaceutical companies and Fortune 500 healthcare corporations. These arrangements supported a range of new construction and renovation work, with services defined in individual statements of work.
