We represented an owner, developer, and operator of residential, commercial, and hospitality real estate, to negotiate both an Owner-Architect Agreement and Owner-Contractor Agreement for the adaptive reuse of a 22-story high-rise building. For the architect, we used AIA Document B108–2009, Agreement Between Owner and Architect for a Federally Funded or Federally Insured Project, with HUD-required contract document amendments. The Owner-Contractor Agreement was with a joint venture of two major construction companies, using a contract comprised of HUD-mandated Contract Documents, plus AIA Document A201-2017, General Conditions of the Contract for Construction, to set forth the respective obligations of the owner, architect, and contractor during the construction phase. The project involves converting the building into a 300-key hotel with guest rooms, public areas, a rooftop bar, and restaurant/bar spaces in a major urban area. The target construction budget was $75 million.
