We negotiated a $9.75 million AIA Document A141–2014, Agreement Between Owner and Design-Builder for our client, an innovative modular construction company undertaking a complex residential project. The project involved the design and construction of 13 three-unit residential buildings, totaling thirty-nine modular units, delivered and assembled on-site, often in a single day, in a four phase project. The agreement included a phased payment schedule tied to delivery milestones and provisions addressing potential cost adjustments and project delays. Our client’s unique off-site construction process allowed for rapid project delivery, with each phase expected to be completed within forty-five days of the modules arriving on site. This efficient approach significantly accelerated the overall project timeline compared to traditional construction methods and required out of the box thinking when structuring our clients’ contracts and subcontracts.
