$20M Design-Build Distribution Center Agreement Negotiated

We represented an architecture firm to negotiate AIA Document B143–2014, Agreement Between Design-Builder and Architect for a major distribution center. The project involved rebuilding a 300,000 sq ft section of a 600,000 sq ft facility severely damaged by a tornado. This $20 million reconstruction envisioned two phases: the building shell followed by the interior. Our client’s scope of services focused on shell architectural design, replicating the original design. The design-builder was responsible for all engineering and tenant improvements. We negotiated provisions protecting our client from potential intellectual property claims and ensuring prompt owner payment of our client’s $400,000 fee, reflecting its agreement to rapidly complete design documents on an expedited schedule.
