We represented an architecture firm to negotiate an AIA Document B101-2017, Agreement Between Owner and Architect, for a four-story, 150-unit senior housing project. The 125,000 sq ft, $40 million project, on a 200,000-plus sq ft site, involves a complex program encompassing residential units, communal spaces, and support services. We also negotiated AIA Document C401-2017, Agreement Between Architect and Consultant, with the structural, mechanical, electrical and plumbing (MEP), interior design, and landscape/civil engineering consultants. A key aspect of our representation involved addressing the project’s development history, which included pre-existing entitlements. We negotiated provisions to protect our client from liability for the prior architect’s work and ensured compensation for any additional services required to navigate potential new entitlement issues. The project aims to achieve a prominent green building certification and incorporate sustainable design elements, while adhering to state housing authority standards.
