Agreement Negotiated for $21M LIHTC Mixed-Use Project

We negotiated an AIA Document B101-2017, Agreement Between Owner and Architect for a new six-story mixed-use development for our architecture firm client. The $21 million project, financed with Low-Income Housing Tax Credits (LIHTC) and other public funding mechanisms, includes some 45 affordable housing units and ground-floor retail space, along with a surface parking lot on land leased from a transit agency. The architect’s fee was about $950,000. Its services included two permit packages, participation in the bidding process, and design to achieve a sustainable objective certification. The agreement addresses the complexities of coordinating design and construction next to both an active transit line and an historic structure, delineates responsibilities regarding tenant improvements, site access, and utility connections, navigates the intricacies of the public financing requirements involved, and incorporates subconsultant services for structural, mechanical, electrical, plumbing, fire protection, civil, and landscape disciplines into the agreement.
