Architect Collects Fees on 200-Unit Federally Funded Housing Project

Our architecture firm client came to us seeking advice regarding a payment dispute on a federally funded renovation of over 200 residential units involving AIA Document B108–2009, Agreement Between Owner and Architect for a Federally Funded or Federally Insured Project. The architect had completed 100% of Schematic Design and Design Development, and 70% of Construction Documents, billing about $185,000 for services rendered, but had not received payment. We provided counsel and assisted the architect in navigating options for suspending or terminating the contract to secure payment. Ultimately, the dispute was resolved without litigation, the project moved forward, and important relationships between the parties were maintained.
