ConsensusDocs 410 Standard Design-Build Agreement

We represented a community organization – on a substantially discounted, near pro bono basis – to negotiate a ConsensusDocs 410 Design-Build Agreement for renovations to its services facility with the design-builder. This public grant-funded project focuses on improvements to maximize available funds while adhering to prevailing wage and other requirements. The rider strengthens the owner’s position by clarifying the design-builder’s fiduciary duty regarding cost control and budget compliance, enhancing communication, and refining substitution procedures. It also bolsters warranty provisions, details payment and lien waiver procedures, and addresses insurance, design document ownership, dispute resolution, and grant compliance.
