Firm Advises Architect on Defective HVAC Design Claim

We counseled an architecture firm regarding a demand letter received from its building owner client alleging design errors and omissions in the building’s HVAC system. The owner claimed the system was defective, citing problems with airflow, inadequate cooling and humidity control, and resulting moisture damage. The owner demanded system replacement and damages. We advised the architect on initial steps to take upon receiving the claim and how to coordinate with their insurance broker to ensure appropriate support and engagement of professional liability defense counsel.
