We guided an architecture firm in creating a subconsultant contracting strategy for an adaptive reuse project. We developed custom bridging terms and conditions to offer interim protection, allowing the design team to begin work before “real” contracts were signed. Our client used these terms and conditions when accepting the proposals issued by its engineering subconsultants, creating a more complete interim contract structure and enabling the project to begin before execution of AIA Document AIA Document B101-2017, Agreement Between Owner and Architect and AIA Document C401-2017, Agreement Between Architect and Consultant. This strategy ensured the architect’s interests were safeguarded during the interim period.
