When a public project owner asked for a reduction in our architecture firm client’s scope of services – eliminating construction administration, to lower the owner’s project costs – we protected our firm client by negotiating a release of liability from the owner for any issues which may arise due to lack of architect oversight in the construction phase. The agreement also contained additional service provisions for value engineering design modifications, partially offsetting our client’s reduced construction administration scope, and fee, while still achieving the owner’s goals.
