To avoid a dispute, we represented a modular construction company to negotiate an amended AIA Document A141–2014, Agreement Between Owner and Design-Builder, for a modular residential project significantly affected by COVID-19. Originally contracted as a 10-unit project, pandemic-related disruptions required a reduction in scope to two units, with remaining units deferred until supply chain stabilization. We negotiated an amended A141-2014 reflecting this new scope, including increased pricing for our client to account for pandemic-related cost escalations, plus custom terms to reflect the accounting and billing implications of applying existing deposits for 10 modular units to the reduced two-unit scope. We also negotiated new completion deadlines aligned with the changed project timeline. This helped stabilize the project, its owner and our client, in a volatile pandemic-impacted market while preserving the viability of the project.
