Firm Guides Developer Through $18M Facility Renovation Challenges

Representing a privately held commercial real estate investment and development firm on its inaugural project in a key new market, we helped the developer navigate substantial geotechnical and civil issues arising after the completion of an $18 million facility renovation and site expansion. Our client’s project encompassed an approximately 400,000 sq ft, 225-plus truck door terminal and other facilities on an over 100-acre site and included the renovation of existing structures and development of more acreage for trailer parking. The emergent issues carried significant implications for our client’s relationships with its equity partners, lenders, and tenants – successful resolution was critical for the client’s reputation and prospects in this new market. Leveraging our national network of construction attorneys, we assembled a team of local experts, including legal counsel, to provide on-the-ground support. We orchestrated a strategy involving forensic inspections, expert witness retention, and insurance involvement, remaining aware of critical deadlines for formal claims while exerting strategic pressure for a negotiated resolution.
