We recorded a complex mechanics lien claim, representing the final payment on an $8 million design-build renovation project in a luxury, high-rise condominium building undergoing a de-conversion to apartments. This already intricate process was complicated by the financial troubles of the entity attempting the de-conversion. Overextended and facing multiple lawsuits, this entity’s disorganization contributed to the lack of payment to our client. The mechanics lien required meticulous allocation of claim dollars across both common areas dozens of individual condo units, their owners and respective mortgage lenders, and the building’s common elements – a high-stakes endeavor given the potential for disputes from the many parties involved in the de-conversion, many of whom were already engaged in legal battles. The situation, widely reported in local media and real estate journals, created a minefield of legal complexities, and any misstep in allocating the mechanics lien could have drawn us into litigation. Despite these challenges, we successfully secured full payment for our client within months, avoiding entanglement in the surrounding drama.
