We represented a general contractor to negotiate a stipulated sum Owner-Contractor Agreement for apartment renovations in an occupied building. The project presented logistical challenges for both contracting and construction because of the mandate to reduce disruption to residents. The aggressive 90-day completion timeline, with associated liquidated damages for delays, amplified the complexity of the project. We successfully negotiated contract terms that balanced our client’s need for efficient project execution with the building’s operational requirements and paramount resident considerations.
