Developer’s Negotiated Contract on 745-Unit Mixed-Use Project

We represented the project owner – a nationally recognized development, architecture, construction, and property management firm with a diverse portfolio of projects across multiple sectors – to negotiate an Owner-Architect Agreement with a large architecture firm for a significant mixed-use development. The project, encompassing five mixed-use buildings, 715 multi-family units, substantial office and retail space, and extensive public and private infrastructure, presented complex challenges. We navigated these challenges, securing favorable terms for the owner while ensuring the agreement remained balanced and workable for the architect. Recognizing the importance of “insurable” contract terms, we carefully crafted provisions to protect the owner’s interests without introducing undue risk which might void the protections of the design team’s professional liability insurance. This balanced approach, informed by our experience representing both owners and architects, led to an agreement that protects our client’s investment while fostering a collaborative and productive owner-architect relationship.
