Representing a privately held commercial real estate investment and development firm, we resolved a significant contract dispute with a general contractor on a critical tenant improvement project. The project, designed to meet the specific needs of a federal government entity tenant, faced substantial challenges because of the contractor’s repeated submission of unsubstantiated and untimely delay notices, coupled with inflated and inadequately documented change orders. These issues stemmed from the contractor’s failure to accurately account for long-lead times on critical equipment and their persistent submission of poorly justified change orders with unreasonable pricing. Through proactive communication, aggressive documentation of the unsubstantiated nature of the contractor’s claims, we helped our client get the project back on track without resorting to formal litigation, protecting its interests and achieving a cost-effective resolution.
