We represented a general contractor in a dispute involving a project affected by COVID-19. The owner tried to terminate the contract, alleging delays, incomplete work, and construction defects. We defended the contractor, arguing that the owner’s indecisiveness, design changes, and refusal to cover increased costs due to market disruptions were the primary causes of the project’s difficulties. We also highlighted the impact of subcontractors abandoning the project during the pandemic and the challenges posed by deficient design plans. Through negotiation, we countered the termination attempt, negotiating for a revised payment schedule that included compensation for unapproved change orders and out-of-scope work, and established a path to project completion contingent on the owner providing missing design information and specifications.
