Firm Helps Contractor Navigate Licensing Error and Labor Risks

Our client, a general contractor overseeing two projects (one publicly funded) faced a complex legal and regulatory challenge due to a subcontractor licensing error. Because of a clerical mistake by others, an incorrect license – belonging to a similarly named but unrelated subcontractor – was mistakenly listed on both projects’ filings. Repetition of the error on both projects made it appear as though the mistake was intentional and, in this instance, created the appearance of impermissible mixing of union and non-union labor, attracting the attention of governmental authorities. The misidentified subcontractor hired counsel and threatened legal action. We stepped in to help the general contractor navigate this sensitive situation. By addressing both the legal and potential labor dispute risks, we protected our client from significant financial and reputational harm, preserving the viability of both projects.
