We represented a general contractor facing accusations of breach of contract, non-payment of subcontractors, and submission of false payment applications. The dispute originated from the owner’s failure to pay a substantial sum due on a payment application certified by the architect two years before. This non-payment resulted in multiple lawsuits against our client by unpaid subcontractors, complicating its efforts to close out the project. We aggressively defended and quickly disposed of the subcontractor lawsuits, which were baseless due to carefully drafted pay-if-paid subcontract provisions. We defended against the owner’s accusations and aggressively prosecuted our client’s claims for payment. Ultimately, we secured payment for our client, resolved the subcontractor lawsuits and liens, and brought the matter to a conclusion.
